General terms of the online store

This website (hereinafter "the Store") constitutes the online sales store of the products of the sole proprietorship of Emmanuela Alevizopoulou under the trade name "Emmanuela - handcrafted for you" (VAT No. EL053866282, Tax Office of Ionia, G.E.MI. No.: 37768905000) based in Greece, in Chalkidona Thessaloniki, Gymnasiou 15, 57007 (hereinafter "Business"). These General Terms and Conditions of Transactions (hereinafter, the "GTC") aim to clearly, distinctly, and understandably state, observing the principle of good faith and the provisions governing the validity of legal transactions, the terms that govern and regulate the relations of the business with each visitor and/or customer of the Store, in accordance with Law 2251/1994 on "Consumer Protection" and specifically the provisions concerning distance selling and Law 2472/1997 on "Protection of individuals from the processing of Personal Data", as currently in force.

Every entry, browsing, and transaction you make with the Store makes you a visitor and/or customer of the Store. Before proceeding with your browsing within the Store, please confirm that you have read and fully understood these Terms and Conditions and that you accept them, as any use and/or transaction with the Business through the Store henceforth implies your full and unconditional acceptance of these Terms and Conditions.

Personal data

The business confirms that it will not use your personal data for any purpose not specifically authorized by you, nor will it send or disclose your data to third parties (natural or legal persons) not connected with the business without your explicit and specific consent, except in cases where disclosure is necessary for the execution of your order (e.g., cooperating shipping companies) or is mandatory by law.

However, a necessary condition for the initiation and completion of our transaction is your disclosure of certain personal data, such as your full name and contact details, your payment information (e.g., your credit card number), your address for the shipment of your order, etc. Also, while browsing the Store using your personal account on emmanuela.gr, the business may collect information from your computer's operating system, your browser, and the internet service provider's address (IP) for measuring traffic, creating order history and purchase interest for the purpose of improving its services or maintaining internal accounting records.

Minor visitors to the Store may access it and its services only with the consent and under the supervision of their parents or guardians. Without being obliged to submit their personal data. In case such data is submitted by minors, the business immediately deletes the relevant information.

The Store allows its visitors/customers to access the file where their personal data collected and stored as above are kept and to make corrections, deletions, modifications, and additions to the data and information they have submitted to it

In this case, it is clarified that the business and the Store bear no responsibility for the content of these linked websites and their use by visitors/customers as they are outside the Store and outside the control of the business. The indication of these links does not imply a statement by the business regarding their reliability, security, and content, the services and products provided through them, and their use is at the sole responsibility of the visitors/customers. Therefore, for any problem that may arise during your browsing of these linked websites or in relation to your transactions with them, please contact their administrators directly, who bear exclusive responsibility for these websites.

Products for sale

The products sold by the Store are products of the business (hereinafter the "Products"). The characteristics and other accompanying elements of these sold products are available and you can find out about them by following the search instructions listed in the Store and selecting (click) the name of the corresponding product. The prices listed in the relevant catalogs next to each product include VAT (24% or 19% for Germany). These prices refer to the Products and the quantities available in the business's warehouse, while the Store reserves the right to adjust prices without notice.

Order Submission/Cancellation

Submitting an order for Products constitutes a binding purchase offer for the said Products at the total price stated at the time of order submission, which includes VAT, packaging and shipping costs, other applicable charges, and any discounts you are entitled to as a visitor/customer. Your order is completed upon acceptance by the business through sending a written confirmation (confirmation email) to you at the email address you provided when placing the order. If you do not receive a confirmation message of your order, please contact the Store immediately at sales@emmanuela.gr to request successful completion of your order submission.

The Store uses a mechanism for canceling an order (in whole or in part) that has already been placed and not yet delivered. For any cancellation of an order (in whole or in part), you must send an email to questions@emmanuela.gr or call (+30) 2391021132. This option is available to you until the moment we inform you about the shipment of your order. After this point in time, cancellation is not possible.

Payment

Payment for each order is made with absolute security using VISA and MASTERCARD credit cards from any bank through SSL Security Protocol (Security Certificate & SSL Technology), the confirmation of which is conducted through the 3D Secure Network system of VISA and MASTERCARD. Also, payment is possible via secure PayPal transaction, deposit to one of our bank accounts, or cash on delivery.

emmanuela.gr has taken all necessary measures to ensure the security of transactions using your credit card. However, in the event that fraudulent use of your credit card is proven, your charge may be canceled upon your request to the Bank that issued your credit card, which is obliged to investigate your complaint or claim. For this reason, you are required to immediately notify the issuing Bank as soon as you realize that this event has occurred, so that it can be canceled and its use by unauthorized persons can be blocked.

Method - Time - Shipping cost

The Products are of excellent quality and carefully packaged. If you indicate so when placing your order, the Products can be sent at your own risk and expense via courier service and no later than 5 working days from the date of order confirmation to the address you specified when placing the order. Shipments are made daily, except Saturdays, Sundays, and holidays. The shipping cost is the same for delivery throughout Greece.

The shipping time of the Products is subject to availability of the ordered items in the Store's warehouses as well as force majeure reasons (e.g., bad weather conditions, strikes, etc.), in which case we will inform you via email or phone so you can indicate whether you wish to complete your order under these conditions.

Prices of sold products

The prices listed in the relevant catalogs next to each product include VAT (24% or 19% for purchases from Germany). These prices refer to quantities available in the store's warehouse, while the Store reserves the right to adjust prices.

Withdrawal - Product Returns

General Return Terms

Returns are accepted within 14 days from the date of receipt, with return to the business address.
Return shipping costs are borne by the buyer.
The product or products must be in the condition in which you received them, not used, worn, soiled, or in any other condition beyond their original state, and the security tag must not have been removed.
In case of return, it is necessary to inform us by email or phone about the return. Returned products can be exchanged for another type, size, or color, or you can receive a refund. We will refund you the value of the product. Returned products are your responsibility until they reach us. Make sure they are properly packaged and cannot be damaged during transport. Returns received outside the terms of our policy will not be accepted.

How do I return the product?

If you want to return a product, please first contact us at questions@emmmanuela.gr or by phone at 2391021132, stating your order number, the product or products you wish to return, and the reason for their return.

Return of defective product

All our products undergo quality control before being shipped. However, if you encounter any problem and the product you received is defective, you should follow the steps below:

Fill out the attached Return Form you received with your order.

Place the return form together with the product you wish to return in a secure package.

Call ACS courier & return the package to the address Emmanuela Alavizopoulou, Gymnasiou 15, 57007, Chalkidona N. Thessaloniki, Greece, with charges to the recipient, i.e., emmanuela.gr

Emmanuela.gr will either replace the defective product with a new one (depending on stock) or refund your money.

In the case of a replacement, we will need 3-5 working days from the receipt of the return to complete the process and send the new product.

In the case of a refund, it will depend on the payment method used for the original purchase. That is, payment by cash on delivery will be refunded to the bank account you declared in the return form, payment by credit/debit card will be refunded to your card, and similarly payment via PayPal will be refunded to your PayPal account.

How will my money be refunded?

As soon as we receive your return, the refund process will begin. The method of refund depends on the payment method you chose. Thus, the amount will be refunded either by canceling the charge on your credit card, or by refunding the money via Paypal, or by depositing the amount within seven (7) working days into the bank account you indicate to us provided you paid by cash on delivery.

What amount will be refunded to me?

We will refund you the amount corresponding to the value of the products and any shipping costs.

Intellectual Property Rights

Except for explicitly mentioned exceptions (third-party copyrights, partners, and organizations), all content of the website, including images, graphics, photos, designs, texts, the overall appearance, the provided services and Products, and generally all files of the Store are intellectual property, designs, distinctive features, marks, symbols, signs, and registered trademarks and service marks of the business, its affiliated companies and enterprises, and its suppliers, and are protected under the relevant provisions of Greek and European law as well as international conventions. Other products or services that may be mentioned in the Store and bear the marks of the respective organizations, companies, partners, bodies, associations, or publications constitute their own intellectual and industrial property and therefore they bear the related responsibility.

Liability of the parties

The visitor/customer, by accepting these Terms and Conditions and browsing the Store, responsibly declares that they are legally capable of entering into this agreement as well as using the Store under the terms and conditions stated herein. Also, as a visitor/customer of the Store, you agree and accept that you are financially responsible for any use of the Store as well as for the use of your account on www.emmanuela.gr by others – including people living with you – and thus you agree to supervise any use of the Store made by minors using your account or your name. The business, including its advisors and employees, is liable only for intent or gross negligence and only for direct damage, and its liability cannot exceed the value of the sold Products.

Applicable law and other terms

The Business and the Store reserve the right to modify or update these Terms and Conditions in writing without notice, which shall be effective from the date of their posting on the Store. Failure to exercise any right of the business shall not be interpreted as a waiver of that right.

Your navigation, use, and transaction with the Store are governed by Greek law, European Union law, as well as relevant international treaties. Any dispute arising during navigation, use, and transaction with the Store shall be submitted for adjudication to the competent courts of Thessaloniki, Greece.

Consumer right to complaint through the online dispute resolution platform

According to Directive 2013/11/EU, which was incorporated into Greece by Joint Ministerial Decision 70330/2015, the possibility of electronic consumer dispute resolution through the Alternative Dispute Resolution (ADR) procedure is now provided throughout the European Union. If the customer has the status of a consumer (i.e., a natural person acting outside professional capacity) and has any problem with a purchase made from our Website, they can initiate the ADR procedure through the single pan-European platform for online dispute resolution (ODR platform) available at https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage

Any provision of the above terms that becomes contrary to the law shall automatically cease to apply and shall be removed from this document, without in any case affecting the validity of the remaining terms.
